Article 2 – Object
These Terms of Service (ToS) define the conditions for accessing and using the Visiora SaaS platform. Visiora is a service intended exclusively for professionals, designed to improve their local visibility, manage their online presence, and centralize the reception of client requests. Visiora acts as a technical provider and is in no way a commercial intermediary or business introducer. Use of the platform does not guarantee client acquisition or revenue.
Article 3 – Definitions
- “User”: Any professional registered on the platform.
- “End Client”: Person visiting the User's local page or Google profile.
- “Local Page”: Web page generated by Visiora presenting the User's activity.
- “Request”: Contact made by an End Client via the chatbot or Visiora tools.
- “Subscription”: Paid plan allowing access to Visiora services.
Article 4 – Access to Service
Access to the service is reserved for professionals capable of entering into contracts under French law. Account creation is required. Access requires compatible computer equipment and an Internet connection. Visiora strives to maintain service accessible 24/7 but does not guarantee absolute availability.
Article 5 – Account Creation
The User agrees to provide accurate, complete, and up-to-date information. Each account is personal and unique. The User is solely responsible for the confidentiality of their credentials. Visiora reserves the right to suspend any account suspected of fraud or identity theft.
Article 6 – Description of Services
Visiora provides the following tools:
- Creation and hosting of SEO-optimized local pages.
- Tools for managing and optimizing Google Business Profiles.
- Integration of a guided chatbot assistant for request collection.
- Interface for centralizing received requests.
- Visibility statistics.
⚠️ Visiora does not guarantee any specific results regarding search engine ranking (SEO), volume of requests received, or revenue generated.
ℹ️ As Visiora is a constantly evolving service, the User accepts that features may evolve, be modified, or removed without notice, in a spirit of continuous improvement.
Article 7 – Request Assistant (Chatbot)
The chatbot tool offered by Visiora is a guided conversational form intended to collect the End Client's needs. It is not an autonomous generative artificial intelligence. Visiora does not intervene in the content of exchanges and is not a party to the relationship between the User and the End Client. Visiora cannot be held responsible for the responses provided, the quality of requests, or the outcome of exchanges. Visiora guarantees neither the completeness nor the relevance of information entered by End Clients.
If the service enables file transfer (photos, documents), Visiora exercises no prior control over these uploads. The User is solely responsible for verifying, storing, and ensuring legal compliance of such files, and refrains from processing illicit or sensitive content via this channel.
Article 8 – Third-Party Service Dependency
Visiora relies on interconnections with third-party services (Google Business Profile, hosting providers, payment solutions, messaging). The User acknowledges that Visiora is not affiliated with Google and has no control over its algorithms or decisions. Visiora cannot be held liable for malfunctions attributable to these third-party services. Consequently, Visiora does not guarantee connectivity permanence with Google, nor the online maintenance of profiles, which may be suspended or removed by Google at any time without Visiora's liability.
Article 9 – Google Business Profile Responsibility
The User remains the sole and unique owner and responsible party for their Google Business Profile(s). Visiora acts exclusively as a technical management assistance tool. The User guarantees the accuracy, legality, and compliance of the information they transmit to Google via the platform. Visiora cannot be held responsible for the rejection, suspension, or deletion of a profile by Google following the User's actions.

Article 10 – User Content and Security
The User is solely responsible for the content published via Visiora and guarantees holding the necessary rights. It is the User's responsibility to keep a backup copy of the data transmitted. Visiora implements reasonable security measures to protect data but cannot guarantee absolute security against intrusions or data loss.
Article 11 – Visitor Data (GDPR)
In the context of transmitting Requests, Visiora acts as a technical subcontractor. The User is the Data Controller for their End Clients' data. Visiora collects this data solely to transmit it to the User and does not use it for other commercial purposes. The User agrees to comply with GDPR regulations in managing this data.
Article 12 – Service Areas
The User defines their geographic service areas themselves. Visiora may offer automatic recommendations, but final validation lies with the User. The accuracy of these areas is the User's responsibility. Visiora does not guarantee specific visibility across all declared areas.
Article 13 – Subscriptions and Payment
Services are offered as subscriptions (monthly or yearly). Prices are indicated in Euros excluding taxes (HT). Payment is made by credit card via our secure provider (Stripe). The subscription is tacitly renewed at each term unless previously terminated. Any payment default may result in immediate suspension of services.
Article 14 – Right of Withdrawal
Since the Service is intended exclusively for professionals (B2B) and execution begins immediately upon subscription, the User acknowledges that they do not benefit from the right of withdrawal provided by the Consumer Code for individuals.
Article 15 – Termination
The User may terminate their subscription at any time. Termination takes effect at the end of the current billing period. Upon termination, services are interrupted and the Local Page is unpublished. Data associated with the account will be retained for 90 days to allow for potential reactivation, then permanently deleted, unless legally required otherwise. The User remains responsible for exporting their data prior to termination.
Article 16 – Acceptable Use and Prohibitions
The User agrees to use the service fairly. It is strictly prohibited to use Visiora for: spamming, creating fake profiles, distributing illegal or misleading content, or misusing the chatbot for illicit data collection. Any abuse may result in immediate account suspension.
Article 17 – Suspension and Deletion
Visiora reserves the right to suspend or delete an account without notice in cases of: violation of these ToS, non-payment, fraud, abusive chatbot use, illegal data collection, or misuse of the service purpose.
Article 18 – Limitation of Liability
Essential clause: Visiora is subject to an obligation of means.
- Visiora is not responsible for the User's revenue, operating losses, or loss of profit.
- Visiora is not responsible for the User's ranking on Google or other search engines.
- Visiora is not responsible for disputes between the User and their End Clients.
- Visiora does not guarantee the accuracy of information transmitted by End Clients.
Article 19 – Availability and Support
Interruptions for maintenance, updates, or technical constraints may occur. Visiora does not guarantee perfect continuity of service and cannot be held responsible for the consequences of temporary unavailability. Visiora provides technical support via email, without guaranteed response times. No strategic assistance (SEO coaching, marketing) is included in the subscription.
Article 20 – Intellectual Property
The structure, design, source code, logos, and Visiora brand are the exclusive property of the editor. Any reproduction or representation, total or partial, is prohibited without express authorization.
Article 21 – Evolution of ToS
Visiora reserves the right to modify these ToS at any time. Users will be informed of substantial changes. Continued use of the service after modification implies acceptance of the new conditions.
Article 22 – Force Majeure
Visiora's liability cannot be engaged in cases of force majeure or events beyond its control (network outages, cyberattacks, host or Google failures).
Article 23 – Applicable Law
These ToS are subject to French law. Any dispute relating to their interpretation or execution falls under the exclusive jurisdiction of the courts designated by the editor's registered office. In case of discrepancy in interpretation, the French version prevails.
